Urge Governor Evers to Sign AB 225 – Support Venue Fairness!
The law in Wisconsin was designed to ensure that lawsuits are heard in a fair and convenient location, typically the county where the incident at hand occurred.
Unfortunately, a growing practice coined "forum shopping" undermines this and has led to court cases in Wisconsin being moved to any county where an insurer happens to do business in pursuit of a more favorable climate for a particular case. This is done even when that county has no real connection to the ongoing dispute other than an insurance company being located there.
AB 225 authored by Representative Cindi Duchow and Senator Dan Feyen addresses this balance by clarifying the law to say that when an insurance company is named in a lawsuit only because it issued a policy or has subrogation rights, its presence cannot be used to justify venue in another unrelated county.
This legislation was passed by both houses and just needs a signature by the Governor to restore fairness in the law and will reduce the number of lawsuits that get moved to Madison or Milwaukee just to find a jury more likely to side with the plaintiff.
